In a recent ruling, the 10th Circuit U.S. Court of Appeals decided to lift an injunction that had temporarily halted a key provision of President Joe Biden’s Saving on a Valuable Education (SAVE) plan. This decision comes as a major victory for the Biden administration, allowing them to move forward with implementing the income-driven repayment plan that aims to provide relief to student loan borrowers.
The SAVE plan, which has already attracted around 8 million borrowers, offers a reduced monthly payment option for eligible individuals. Under this plan, borrowers are required to pay only 5% of their discretionary income towards their student debt each month. Additionally, those earning $32,800 or less have a $0 monthly payment, making it a more affordable option compared to other income-driven repayment plans.
Legal Challenges and Implications
Despite the recent court decision in favor of the Biden administration, challenges to the SAVE plan remain. A separate injunction issued by a federal judge in Missouri still prevents the forgiveness of student debt under the plan. This legal battle stems from lawsuits filed by Republican-led states earlier this year, claiming that the administration’s actions exceed its authority. The Department of Justice is expected to appeal the Missouri court ruling, seeking to overturn the injunction and ensure the full implementation of the SAVE plan.
While the legal hurdles continue, the Biden administration has already achieved significant progress with the SAVE plan. By mid-April, 360,000 borrowers had received $4.8 billion in debt relief, demonstrating the tangible impact of the program. With the latest court ruling allowing the administration to proceed with lowering borrowers’ monthly payments, more individuals are expected to benefit from the financial assistance provided by the SAVE plan.
